General. Quikonnex.com is a web-based service that allows its users to create and update online channels of information (herein referred to as "the Service"). The Service can be updated through a web browser as well as by the use of free downloadable clients ("the Software"). Once registered with Quikonnex.com, each member receives his or her own web space to post text, data, messages, or information concerning or linked to software, music, sound, photography, graphics, and video ("the Content"). This Content may reside on Quikonnex' servers or on the servers of a third party. Members. Members of Quikonnex do not pay for service. They receive restricted access to the affiliate system and community forum and based upon the granting of permissions by a Publisher may have restricted access to a channel for the purposes of adding, deleting or editing items posted in a Member's channel. Members typically are subscribers only and do not provide any personal contact information such as email address or physical addresses. Members that do not provide full contact information are not entitled to receive any payments earned through the Quikonnex affiliate program. Affiliates. Affiliates of Quikonnex do not pay for service, however, they may receive financial benefits based upon their own personal level of effort via the Quikonnex affiliate program. Ebizworks, LLC does not guarantee any success or expected levels of income for any affiliate. They receive restricted access to the affiliate system and community forum and based upon the granting of permissions by a Publisher may have restricted access to a channel for the purposes of adding, deleting or editing items posted in a Member's channel. Publishers. Quikonnex Publishers pay for the use of channels and are granted access to the channel manager, affiliate system and community forum. Online support is provided to support conversion of subscribers to the channel system. Members are also entitled to receive affiliate benefits. Use of Content. Ebizworks, LLC does not claim ownership of the Content you place on your Quikonnex Channel. Small portions of your content (if you have made it public) may be quoted or reproduced in order to promote your channel site and/or the Quikonnex service, but only on a fair-use-type basis. Content not marked as private will also be made available through the Quikonnex search engine. We do not pre-screen Content, however, Ebizworks, LLC and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service. Without limiting the foregoing, Ebizworks, LLC and its designees shall have the right to remove any Content that violates the Terms Of Sale or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. Additionally, we reserve the right to retain content posted on the site for historical archival purposes should any member terminate their membership. Level of Service. Ebizworks, LLC provides no guarantees regarding the accessibility of the site or availability of the Service. Websites are subject to external variables out of our control. Ebizworks will extend all reasonable efforts to minimize service interruptions. Bottom line... we're going to do everything we can do to keep the channels operating! Use of Service Acceptable Use. Ebizworks, LLC does not pre-screen content, however, we expect members to maintain a high quality of decency and not post objectionable content. Such information that is subject to immediate deletion, censorship, and may result in terminate of the member's service is as follows:
Reporting. Members, affiliates and subscribers are encouraged to report objectionable, indecent, illegal or otherwise prohibited content posted to the Quikonnex site. Acceptable reporting may be through posts in the forum, in Qsupport, via Live Support, or by sending an email to abuse@ebizworks.net. Maintenance of high quality information is in the interest of all Quikonnex users. Supported Channel Formats. Quikonnex channels provide users the capability of inserting HTML code, graphics, flash, audio files and will work with many other common web publishing techniques. Members are responsible for ensuring that their coding is correct prior to making information available to subscribers. Items posted should remain in a draft condition until verified that the information is viewable via their channel page or via a client channel viewer such as DeskView. Unsolicited Commercial Email (UCE) aka Spam Quikonnex.com was developed in response to the increasing inability of publishers to deliver their content to their subscribers via email. The reason for this is UCE or Spam. Email that is requested is no longer being delivered because of the anti-spam filtering software installed at ISPs, hosting companies and on users computers. While we recognize the need, we also recognize that email is becoming a significantly lesser communications tool. Along with this decrease in effectiveness, comes an increase in risk associated with operating a website. Spam accusations can easily cause loss of services for many innocent victims. A member or affiliate accused of spamming could cause the shutdown of Quikonnex services and thus any complaint of spamming is taken very seriously and dealt with immediately. Members and affiliates are prohibited from engaging in improper use or distribution of electronic mail ("e-mail") to promote their Quikonnex channel. Mass or commercial email may be sent only to recipients who have expressly requested receipt of such e-mails, by the sending of an email request to the person performing the mass or commercial mailings. This exchanging of requests, acknowledgements, and final confirmations (commonly referred to as a "double opt-in" process) must be adhered to in their entirety for any mass or commercial email to be considered "solicited" by Ebizworks, LLC. Users that send mass or commercial e-mail are required to maintain complete and accurate records of all e-mail subscription requests, specifically including the email and associated headers sent by every subscriber, and to immediately provide Ebizworks, LLC with such records upon request of Ebizworks, LLC. Subscriptions that do not have a specific recipient generated email request associated with them are invalid, and are strictly prohibited. In the absence of positive, verifiable proof to the contrary, Ebizworks, LLC considers complaints by recipients of e-mails to be de-facto proof that the recipient did not subscribe or otherwise request the e-mail(s) about which a complaint was generated. Valid accusations of spamming will result in immediate termination of member channels and termination of member and/or affiliate status. COPPA What is COPPA? The Children's Online Privacy Protection Act (COPPA) was signed into law on October 21, 1998 and is effective as of April 21, 2000. The purpose of COPPA is to regulate the online collection and use of personal information provided by and concerning children under the age of thirteen. On October 21, 1999, the Federal Trade Commission, pursuant to the requirements of COPPA, published final rules in the Federal Register implementing COPPA. The Rules set forth the specific manner in which entities are expected to comply with, and how the FTC will enforce, COPPA. Quikonnex and COPPA To address COPPA, we do not permit children under age 13 to use the Quikonnex.com service without the express permission of their parents. In the event that a child is publishing via a Quikonnex channel it will be done as a co-publisher on a channel created within their parents account. We regret any inconvenience this may cause, but it is simply the easiest way to deal with the problem. Parents... We do not allow channels to be created by children under 13. Channels must be created and monitored by their parents as a sub-account within their parent's primary publishing account. Children cannot participate in the affiliate program aspects of Quikonnex. If you are aware that your young child is using our service, without your permission, and would like their account terminated, please contact our abuse department: abuse@ebizworks.net Expect a response within 24 hours, if not within minutes. Cancellation Policy
Ebizworks, LLC Canceling a paid publisher membership will not cause the cancellation of a publisher's related affiliate account. Canceling Affiliate Memberships Quikonnex affiliate memberships maybe cancelled several ways. Affiliate can request that Quikonnex cancel their affiliate memberships by sending an email to admin@ebizworks.net or by faxing a written request to 1-866-639-3848 or by sending a letter to: Ebizworks, LLC All affiliate records in the Quikonnex.com databases and any other related Quikonnex sites will be removed within 72 hours of notification.
